APEX Performance provides fitness training programs, gym access, personal coaching, group classes, and related services. We strive to deliver high-quality services that help our members achieve their fitness goals.

Services are subject to availability and may be modified or discontinued at our discretion. We will make reasonable efforts to communicate any changes to our members.

As a user of our Services, you agree to:

• Provide accurate and complete information when creating an account or purchasing services
• Maintain the confidentiality of your account credentials
• Use our facilities and equipment responsibly and follow all safety guidelines
• Respect other members, staff, and the community
• Notify us immediately of any unauthorized use of your account
• Comply with all applicable laws and regulations

All membership fees, program fees, and other charges are due at the time of purchase unless otherwise specified. We accept various payment methods including credit/debit cards and bank transfers.

• Memberships are billed on a recurring basis (monthly or annually) unless a single-payment plan is selected
• Prices are subject to change with 30 days' notice to existing members
• All fees are non-refundable except as required by law or as stated in our refund policy

We strive to ensure your satisfaction with our Services. Refunds are handled on a case-by-case basis and are generally offered in the following circumstances:

• Services not delivered as described
• Technical issues preventing access to services
• Billing errors made by APEX Performance

To request a refund, please contact us at info@apexperformance.com within 14 days of the transaction. Refunds will be issued to the original payment method and may take 5-10 business days to process.

All content on the APEX Performance website, including text, graphics, logos, images, videos, and software, is the property of APEX Performance or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

Clients are responsible for their own health and safety when participating in our programs and using our facilities. You should consult with a healthcare professional before beginning any fitness program.

• Disclose any medical conditions or injuries that may affect your ability to participate safely
• Follow instructions provided by coaches and staff
• Use equipment properly and report any malfunction
• Maintain personal hygiene and respect shared spaces

Our programs and services are delivered according to the schedule provided at the time of booking or purchase. We strive to start and end sessions on time and to provide the full duration of each session.

In the event of schedule changes or cancellations, we will notify affected members as soon as possible and provide alternative arrangements where feasible.

APEX Performance respects your privacy and is committed to protecting your personal information. We collect and use your information in accordance with our Privacy Policy.

You agree to keep your account credentials confidential and to notify us immediately of any unauthorized access to your account.

To the fullest extent permitted by law, APEX Performance and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services.

Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease.

You may cancel your membership at any time by providing written notice in accordance with our cancellation policy.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos, Nigeria.
